On 5-7 September 2017, the XXVII Economic Forum in Krynica-Zdrój was held. The Forum is held on an annual basis and is the biggest political and economic event in Central and Eastern Europe, which gathers representatives of the economic and political elite from 60 countries of the world. This Forum is also called "Polish Davos".

This year, the Forum hosted more than 3 thousand guests. Honorary participants of the Forum were the presidents of Poland, Georgia, Macedonia and the former president of Ukraine, Viktor Yushchenko. Two delegates from Kyrgyzstan attended the Forum, including the Lawyer of Kalikova & Associates, Ermek Mamaev.

The All China Lawyers Association initiated the publication of Legal Environment Report of the “Belt and Road” countries. Kalikova & Associates was invited as the author of the section of this report concerning the Kyrgyz Republic.

The team of our lawyers prepared a review report regarding the legislation on investment, taxation, customs control, labor and immigration, protection of intellectual property and anti-corruption legislation.

This publication is a unique contribution of participants from 43 countries, who are members of the “Belt and Road”, and is considered as a handbook covering various sectors of the economy.

Kalikova & Associates lawyers took part in the 5th “Anti-Counterfeiting 2017” international forum, which was held in Bishkek from September 14 to 16, 2017.

The event was organized by the Eurasian Economic Commission, the Ministry of Industry and Trade of the Russian Federation, the International Association “Anti-Counterfeiting”, and the Government of the Kyrgyz Republic.

The forum "Anti-Counterfeiting" is an international event that is held within the framework of the Eurasian Economic Union (EEU). The forum is held on an annual basis from 2012 and is considered as a discussion platform, where representatives of ministries and government agencies of the EEU member states, as well as leading international experts, representatives of the scientific community and the members of the society, have an opportunity to discuss the problems of protecting markets from illegal trade of counterfeit goods and ensuring protection of intellectual property rights, as well as to develop solutions to the problems.

Kalikova & Associates Senior Lawyer Aleksei Vandaev took part in the session “Antimonopoly Control in Cross-border Markets: Unfair Competition” and made a presentation on “Practical Aspects of Suppression of Unfair Competition in the Kyrgyz Republic”.

Kalikova & Associates Managing Partner Ulan Tilenbaev took part in the International Bar Association (IBA) Europe-Caucasus-Asia (ECA) forum, which was held in London from September 6 to 8, 2017.

The legal IBA ECA Forum, formerly known as the CIS Local Counsel, is an international event, which is being held since 2006 on an annual basis. This Forum has become a platform for the wide-scale meetings of lawyers specializing in the field of business support. The ECA Forum brings together managing and senior partners of leading law firms practicing not only in the CIS countries, but also representatives of international law firms.

The main agenda of the forum included:

- Law firm management: How to feel “at home” on the global stage;
- Business going online - new possibilities for e-commerce projects;
- The role of the legal profession in building a corruption-free environment;
- Tackling intercultural challenges...talking the talk.

As a bonus, the delegates were given a relationship building opportunity to visit a number of law firms in London to exchange ideas and network.

On August 15, 2017, the country’s first PPP agreement was signed between the Ministry of Health of the Kyrgyz Republic and Fresenius Medical Care Deutschland GmbH (Germany), selected as a private partner under the PPP project on organization of hemodialysis services in Bishkek, Osh and Jalal-Abad. The term of the agreement is 10 years.

As part of its obligations under the PPP agreement, Fresenius Medical Care Deutschland GmbH undertook to ensure the establishment of dialysis centers, import, operation and maintenance of equipment, training of personnel of public hemodialysis units and provision of dialysis services to patients with chronic kidney failure.

Kalikova & Associates, in consortium with IFC, RebelGroup International, and Dentons, provided assistance to the Ministry of Health of the Kyrgyz Republic in the preparation of the PPP project and selection of the private partner.

In particular, Kalikova & Associates, as a legal consultant for the Ministry of Health, was directly involved in conducting the feasibility study, drafting the tender rules and tender documents, including the PPP agreement, as well as providing legal support during the tender process, including the execution of the PPP agreement with the private partner.

Kalikova & Associates wishes success to the public and private partners in implementing the project and looks forward to further progress in promoting PPPs as effective methods of mutually beneficial cooperation between the public and private sectors.

The Charles University in Prague – the main university of the Czech Republic and the oldest university in Central Europe hosted the Prague Summer Mediation Academy with the participation of the representatives from the United States of America, Italy, Kenya, the Great Britain, Georgia, India, the Philippines and Kyrgyzstan. Ermek Mamaev, a lawyer of Kalikova & Associates, was also admitted to participate in the summer academy.

This course offered participants the opportunity of exploring the general issues on mediation as an alternative way of disputes resolution, mediator tools and skills, foreign mediation experience, as well as issues related to cross-border mediation. Lectures were conducted by recognized experts in the field of mediation and other alternative methods of disputes resolution from the Czech Republic and Ireland.

It should be noted that at the end of June the Parliament of the Kyrgyz Republic approved in the third reading the draft Law of the Kyrgyz Republic "On Mediation", which is designed to relieve the courts by introducing extrajudicial settlement of conflicts with the help of a mediator.

The training for counsels in commercial arbitration took place on July 15 and 17, 2017 at the Advocates Training Center. The training was conducted by the arbitration practitioners: Nurbek Sabirov, Partner at Kalikova and Associates, Elena Babitskaya and Natalia Alenkina.

The training was part of the "Promotion and strengthening of the rule of law in the Kyrgyz Republic” project financed by the European Union.

The World Justice Forum V took place on July 10 – 13, 2017 in the Hague, Netherlands. It was organized by the World Justice Project, an independent multidisciplinary organization, in cooperation with Microsoft Corporation and American Bar Association. The forum attracted 400 delegates from 75 countries, among who were practicing lawyers, current justices of the Supreme Courts, Stanford law school dean, ombudsmen and other representatives of the legal profession.

On the final day of the forum, 10 participants selected out of 400 presented their proposals on projects to strengthen the rule of law in their countries. The person who won the votes of the organizers and all participants of the forum was declared the winner. We are pleased to announce that the prize was awarded to Ermek Mamaev a Kyrgyz national and a lawyer of Kalikova & Associates law firm, who presented a project to strengthen the rule of law in Kyrgyzstan.

The World Justice Project releases the World's Rule of Law Index (The WJP's Rule of Law Index). This Index was introduced in 2010 and measures a country’s achievements in promoting the rule of law. The 2016 Edition expanded coverage to 113 countries with Denmark remaining the highest-ranked country in rule of law while Venezuela is the weakest performer among all the 113 indexed countries. Kyrgyzstan ranks 83-rd.

From the 16th to the 20th of June 2017, Mr. Ermek Mamaev, a lawyer of Kalikova & Associates took part in the first Youth Regional Workshop on Water in Central Asia.The workshop took place in the Swiss Pavilion at Expo Astana 2017: Future Energy.

The workshop was attended young experts from the Central Asian region, including the representatives from the Islamic Republic of Afghanistan, the Islamic Republic of Pakistan and the Republic of Korea. The workshop was organized by the International Secretariat for Water and Swiss Agency for Development and Cooperation and held under the theme "Innovative solutions to water issues in Central Asia: challenges and contributions of young people".

The participants of the workshop met with experts and diplomats from Europe and Canada, including the former President of the Swiss Confederation, currently Swiss Federal Councillor Mr. Didier Burkhalter, who discussed with the participants of the workshop various problems in the water sector and their solutions.

As a result of the workshop, young experts developed their own vision and solutions for Water in Central Asia, which were presented to the official representatives of all Central Asian states during the Blue Peace Central Asia Conference in Astana on July 20, 2017.

Nurbek Sabirov, Partner of Kalikova & Associates, prepared a handbook on arbitration “Concepts and legal regulation of arbitration in the Kyrgyz Republic”, which was published as part of USAID and IDLO project on strengthening the justice system in the Kyrgyz Republic.

The handbook was developed based on practical experience for the training of arbitrators of arbitration courts under the support of USAID and IDLO.

Nurbek Sabirov is an advocate and acting arbitrator of the International Court of Arbitration under the Chamber of Industry and Commerce of the Kyrgyz Republic, arbitrator of Riga International Commercial Arbitration Court and arbitrator of the Georgian International Arbitration Centre (GIAC).
